1. About these terms

These Terms of Service ("Terms") govern your use of the Druk Connect mobile application and website (together, the "Platform"), operated by Lam Penjor, trading as Druk Connect (ABN 15 184 654 507), a sole trader based in Western Australia ("Druk Connect", "we", "us", "our").

The Platform is operated from Australia and is available to users in Australia and Bhutan.

By creating an account or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.

Your Australian Consumer Law rights. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. Where our liability for breach of a non-excludable guarantee can be limited, it is limited as set out in clause 12.


2. Who can use Druk Connect

You must be at least 16 years old to create an account. If you are under 18, you may only use the Platform with the involvement of a parent or guardian, who is responsible for your use — including registering you for events or tournaments and any payments.

You are responsible for keeping your account secure and for activity that occurs under your account.


3. What Druk Connect is — and is not

Druk Connect is a platform that connects the Bhutanese community in Australia with events, organisers, businesses, and community services. We provide the technology; we are generally not the organiser of events, the seller of tickets, or the provider of the businesses and services listed.

This means your contract for a ticket, service, or listing interaction is primarily with the organiser or business, not with us — although your non-excludable rights under the Australian Consumer Law continue to apply against the relevant supplier, and against us where we are the supplier.


4. Tickets, payments and refunds

Payments. Card payments are processed by Stripe. For Bhutan-based events and sponsors, payment is made by bank transfer through the process shown in the app; access is granted after we verify the transfer, which may take additional time.

Refunds and cancellations.

Fees. Where fees apply (for example, ticketing or platform fees), they will be disclosed before you pay. We are registered for GST, so any fees we charge you are inclusive of GST where GST applies, and we will provide a tax invoice on request. Prices set by organisers and businesses are their responsibility, including whether those prices include GST.


5. Donations (Dana)

Where an event enables Dana (donations), any amount you give is a voluntary gift to the organiser or the nominated recipient. Donations are generally not tax-deductible unless the recipient is a registered Deductible Gift Recipient (DGR) and states so. Donations are typically non-refundable except where required by law.

7. Your content and conduct

You retain ownership of the content you post. By posting content, you grant us a non-exclusive, royalty-free licence to host, store, display and distribute it for the purpose of operating and promoting the Platform.

You agree not to post or do anything that:

Moderation and takedown. We may review, moderate, and remove content, and suspend or terminate accounts that breach these Terms. If you believe content on the Platform is harmful or unlawful, you can report it via [email protected] and we will handle your report consistently with our obligations, including under the Online Safety Act 2021 (Cth).


8. Tournaments and competitions

Where the Platform hosts tournaments or competitions, additional rules (eligibility, fees, conduct, scheduling, and results/dispute handling) may apply and will be shown at registration. Entry fees are handled the same way as ticket payments (clause 4). You must comply with the organiser's rules and act fairly and respectfully toward other participants.


9. Notifications

By enabling notifications, you agree to receive the categories of push notifications and messages you have opted into. You can change these at any time in Profile → Notifications. See our Privacy Policy for how we handle marketing communications.


10. Intellectual property

The Platform itself — including its software, design, branding, and the "Druk Connect" name and logo — is owned by us or our licensors. You may not copy, modify, reverse-engineer, or create derivative works from the Platform except as permitted by law.


11. Third-party services

The Platform relies on third-party services (including Stripe, Google Firebase, Cloudflare, and Mapbox) and may link to third-party websites. We are not responsible for third-party services or content, which are governed by their own terms and privacy policies.


12. Liability

To the maximum extent permitted by law, and subject to the ACL rights preserved in clause 1:

Nothing in this clause limits liability that cannot be limited by law.


13. Suspension and termination

You may stop using the Platform and delete your account at any time (Profile → Delete Account). We may suspend or terminate your access if you breach these Terms or where we are required to by law. Provisions that by their nature should survive termination (including clauses 7, 10, 12 and 14) will survive.


14. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and give you reasonable notice in the app before the changes take effect. Continuing to use the Platform after changes take effect means you accept the updated Terms. The current version is always available at https://drukconnect.app/terms.


15. Governing law and contact

These Terms are governed by the laws of Western Australia, Australia, and you submit to the non-exclusive jurisdiction of its courts.

If you use the Platform from Bhutan or another country, you remain subject to these Terms, and you are responsible for complying with any local laws that apply to you. Nothing in this clause removes any right you have under a consumer protection law of your own country that cannot lawfully be excluded.
